Welcome to Pathokart Diagnostics ("Pathokart", "we", "us", or "our"), operational via https://pathokart.in, our digital web booking interfaces, mobile web views, and automated communication platforms including the Meta WhatsApp Cloud API.
This document establishes our privacy commitments, data handling practices, and clear legal boundaries governing our healthcare facilitation platform.
⚠️ 1. Nature of Service: Pure Technology & Logistics Facilitator Only
Non-Laboratory Intermediary Status: Pathokart Diagnostics operates strictly as a digital aggregator, booking intermediary, and sample collection logistics provider. Pathokart is NOT an independent pathology laboratory, medical council, or diagnostic analysis center.
Independent Partner Testing: All biological specimens (blood, urine, etc.) collected via our phlebotomists are processed and analyzed exclusively by certified, authorized, and NABL/accredited independent partner diagnostic laboratories. The clinical interpretation, diagnostic reference ranges, and report sign-offs are conducted solely by licensed pathologists at partner labs.
Complete Clinical Non-Liability: Neither Pathokart nor its founders, directors, employees, phlebotomists, rider agents, or software contractors assume any clinical, diagnostic, civil, or legal liability for laboratory report accuracy, analytical errors, false positives/negatives, biological variations, or consequential medical treatments. Any diagnostic grievance or clarification must be addressed with the testing laboratory identified on the official report.
2. Information We Collect
To schedule sample pickups and deliver reports, we collect:
- Personal Identity & Contact: Full name, age, gender, active mobile number, delivery address/pincode, and email ID.
- Medical & Test Booking Details: Tests selected, prescription doctor details, sample collection time preferences, and prescription uploads (if submitted by the patient).
- Communication Logs: Chat history, opt-in records, status queries, and automated interactions conducted via the WhatsApp Cloud API.
- Technical Data: IP address, device browser information, and transactional network timestamps recorded for security and auditing purposes.
3. How We Use Customer Information
- To dispatch trained phlebotomists to your doorstep for sample collection.
- To tag barcoded samples and deliver them securely to accredited partner testing laboratories.
- To send automated appointment alerts, phlebotomist tracking, and authentic PDF diagnostic reports via the official WhatsApp Business Cloud API and email.
- Zero Commercial Monetization: We do not sell, rent, commercialize, or trade your medical test inquiries or contact details to third-party telemarketers, insurance brokers, or advertisers.
4. WhatsApp Business Cloud API & Messaging Consent
- User Consent (Opt-in): By booking a test or initiating a chat with our WhatsApp number, you grant explicit consent to receive service updates, appointment reminders, and digital reports.
- Opt-Out Mechanism: You can stop receiving promotional or automated WhatsApp notifications at any time by replying with the word STOP or UNSUBSCRIBE.
- Data Security: Communications through WhatsApp adhere to Meta's enterprise security architecture and 256-bit SSL encryption during transmission.
5. Limitation of Medical Advice
- Information provided through our automated WhatsApp bot, website, or customer support does NOT constitute professional medical advice, clinical diagnosis, or treatment prescription.
- Pathokart phlebotomists and support executives are strictly logistical and administrative staff; they hold no authorization to diagnose diseases, interpret test reports, or suggest medications.
- Patients must consult a qualified medical doctor for proper diagnosis and clinical interpretation of laboratory findings.
6. Sample Recollection & Refund Terms
- Sample Quality (Hemolysis/Clotting): In rare instances where a biological sample is deemed unfit for testing by the partner laboratory (e.g., sample hemolyzed or clotted), Pathokart provides a free re-collection visit.
- Cancellations: Test bookings canceled prior to phlebotomist dispatch are eligible for a 100% refund. Once sample collection has occurred and the sample is handed over to the laboratory, tests cannot be canceled or refunded.
7. User Data Deletion & Privacy Rights (DPDP Act)
Under India's Digital Personal Data Protection (DPDP) Act and international privacy frameworks, users maintain the right to access, rectify, or request complete erasure of their personal contact details and booking logs. To request account deletion, send an email to indianlogon@gmail.com with your registered mobile number. Erasure requests are processed within 7 business days.
